Probation in the UAE has one of the more nuanced notice-period structures in the Gulf — the required notice actually depends on who is ending the employment and why, not just a single flat number.
The 6-month cap
Under Article 9 of Federal Decree-Law No. 33 of 2021, probation cannot exceed 6 months from your actual start date. It can't be extended, and the same employer can't put you on probation twice.
Three different notice periods
Ending employment during probation isn't one-size-fits-all:
- Employer ends it: at least 14 days' written notice.
- You resign to join another employer inside the UAE: at least 30 days' (1 month) notice — the longer period exists because your new employer may need to compensate your current employer for recruitment and contract costs.
- You resign to leave your job entirely (not moving to another UAE employer) or leave the country: at least 14 days' notice, same as the employer-initiated case.
If either side fails to give the required notice, they owe the other party wages for the notice shortfall.
No gratuity during probation
End-of-service gratuity only starts accruing once you've completed 1 full year of continuous service (Article 51) — see our UAE Gratuity Calculator. Since probation is capped at 6 months, a probation-stage termination never reaches that threshold on its own; but the probation months DO count toward your first year if your employment continues afterward.
Worked example
AED 8,000/month salary, resigning during probation to join a new UAE employer: daily wage = 8,000 ÷ 30 = AED 266.7. 30 days' notice pay (if paid in lieu instead of working it) = 30 × 266.7 = AED 8,000.
