Can I be paid out LSL if I resign?
In Victoria, yes, once you have 7+ years. In NSW, only at 10+ years for an ordinary resignation; between 5 and 10 years a plain resignation doesn't qualify (illness/pressing-necessity resignations do).
Does interstate service count?
It depends. Continuous service with the same employer generally counts even across states, but which state's Act applies can be complex — check with the relevant authority.
Is there portable long service leave?
Some industries (e.g. construction, cleaning, community services) have portable LSL schemes that follow the worker between employers. These are separate from the state Acts.
Does unpaid leave break continuity?
Some absences count toward service and some don't, depending on the state Act and the type of leave. Long unpaid periods may not accrue LSL.
What if I'm in another state?
Queensland, SA, WA, Tasmania, the ACT and NT each have their own thresholds and formulas — don't rely on NSW or Victorian figures.
Is LSL taxed?
Long service leave paid on termination is taxed, though unused LSL can attract concessional tax treatment depending on when it accrued. Check current ATO rules.
