Probation feels informal, but the details carry real consequences. Avoid these common errors.

Mistake 1 — Assuming a fixed 90-day probation

Since 2025, probation can be set at up to 180 days directly in the contract. The old 90-day default no longer automatically applies — read what your contract states.

Mistake 2 — Expecting a statutory notice period

There is none for probation. Notice is whatever your contract says. If it is silent, termination can be immediate — do not assume you will get 30 days.

Mistake 3 — Thinking only the employer can terminate

Since the amendment, termination rights are mutual by default. You can also end the contract during probation, subject to your contract's terms.

Mistake 4 — Believing you cannot be re-probated at all

You can, in two cases: a genuinely different role, or a gap of at least six months since your previous employment with that employer ended.

Mistake 5 — Expecting compensation on probation exit

Neither side owes gratuity or compensation for ending employment during probation. It is a clean trial window.

Mistake 6 — Forgetting probation counts toward service

If you pass probation, that time is part of your continuous service and feeds into your later end-of-service award. It is not "wiped" once you are confirmed.

The silent-contract risk

The riskiest situation for an employee is a probation clause that says nothing about notice. Because the Labor Law sets no statutory minimum, silence means either side can end the job during probation with no notice at all. Employees often assume a default 30-day protection carries over from the post-probation rules — it does not. Before you sign, ask for the probation notice to be written in explicitly, even if it is only a few days. It is a small ask that converts an open-ended risk into a known quantity, and a reasonable employer will usually agree.
